The True POWER And The RIGHT of The JURY

Why Judge Fogleman needs to be voted out of office

I am doing this for two reasons. First it is my duty to inform my fellow citizens of the truth. Second this is to inform the voters of Arkansas of an Arkansas Supreme Court Candidate who doesn't believe the truth about Jury Nulification. That man is Judge John N. Fogleman.

I had a discussion with Mr. Fogleman in Clinton Arkansas on March 13th 2010 over Jury Nullification. I asked the Judge if he believed in Jury Nullification and he said no he does not, because they are only to judge the facts of the case, (not the validity of the law).

I challenged him over the issue because our founding fathers have said the Jury has the right to judge both the law and the facts. The Judge challenged me back with his version of the facts and that Mr. Thomas Paine is a founder that would support his view. I responded with some other founding fathers to support my view.

NOTE: Not all the founding fathers agreed on all the issues. Jury nullification was decided by consensus.

We ended the discussion with an agreement to research the matter: "The Power and the Right of the Jury to judge both the law and the facts is the issue that will be decided." I just hope that Mr. Fogleman has done his own research to double check himself. I also hope that upon the facts I have found that he would change his position. If he changes his position then a citizen should consider voting for him. However, if he does not amend his erroneous view, then a citizen should not vote for him because that would be re-installing a judge who does not uphold the Constitution.

You may be asking why are you doing this? I am doing this because the truth needs a crusade and I am a firm believer that the "Truth is not always in the majority." Just because the majority says so does not always make it right or the truth. Also this has to do with tyranny and liberty. His position is one of tyranny (It may not be purposeful but his viewpoint could be one of ignorance.) My position is one of freedom, liberty, and the American way and these liberties are in jeopardy in direct proportion to the deviation from the Constitution.

I have collected the quotes from several sources to keep from being accused of cherry picking. The founding Fathers, Supreme Court Justices, Court Rulings, news articles, and The JURY HANDBOOK.

You see it is you the jury that have the final say. Our founding fathers put the power in to the peoples hands. Why? Because to keep us safe from bad law and tyranny of the government. Also to protect us from corrupt judges, prosecutors, city councils, city boards, county boards, county quorum court, state legislatures, and federal legislatures.

Watch all of the interviews. I think the Judge is one who calls it all like it is and he sees through the false left-right paradigm. The Judge looks at all of this stuff from the position of the Constitution and this is what makes him distinct from most News commentators. Also this health care bill reaches into just about every facet of our lives and both Mr. Jones and the Judge discuss this and other very important issues.

Health Care Bill makes Health Care Worse.

I just can't wait for all of the mess to hit the fan, then our government can come in again and say we need reform and in return they just make it worse. Sounds like the old Cloward-Piven strategy at work here.

The Truth About Healthcare in America

The history of healthcare in America is a sordid one at best, and scandalous at least. Consider the following:

1. The Social Safety Net did not exist for the most part prior to the last Great Depression. It wasn't necessary because the family, Church and community took care of their own. Three generations often resided under one roof and homeopathic medicine was the primary treatment for most maladies. Prior to 1929, half of Americans lived on the farm and half in the cities. People took care of their own.

2. Today, 97% of Americans live in an urbanized setting. We no longer grow our own food. The nuclear family, let alone the extended family, no longer exists in most cases. Most of our Churches have become dysfunctional and our communities have grown morally bankrupt.

3. FDR passed Social Security Legislation as part of his "New Deal" legislation in the 1930s. Originally, it only paid out retirement benefits when an individual lived longer than the life expectancy of most Americans.

"When Social Security was launched 70 years ago Sunday, it was meant to be a supplement for retirees, not a full pension. But today, 10.6 million people, or 22% of the 48 million who will receive Social Security benefits this year, live on that check alone, the Social Security Administration says...AARP, the senior advocacy group, says 25% of retired women, including 46% of unmarried Hispanic women, have no income beyond Social Security. AARP also says 33% of retired African-Americans live on Social Security alone.

Those numbers could grow as the baby boom generation enters retirement. Currently, 53% of people in the workforce have no pension, and 32% have no savings set aside for retirement. The number of traditional pension plans — the kind that guarantee a set amount of money for life and that have propped up many of the pre-boomer generation — has fallen to 29,651 in 2004 from 112,208 in 1985...The average Social Security payout is $955 a month, $11,460 annually." Social Security is grossly underfunded without any reserves. Contrary to what most people think, all current Social Security obligations are paid for with borrowed money an current tax obligations. Employers pay 7.65% of the employees payroll up to $102,000 (6.2% for Social Security and 1.45% for Medicare). The employee pays the other half for a total of 15.3% of an employees gross income. The self-employed pay a simular tax, called the self-employment tax.

So, in essence, 15.3% of most peoples income goes into Social Security. Because of using that money for other obligations and not investing it, the program is for all intents and purposes, bankrupt.

This is not being helped by illegal aliens receiving Social Security benefits, or the current 20% real unemployment rate. NAFTA, GATT and multi-national corporations can produce goods and services in third-world countries without the cost of producing them in the US and Europe. In other words, it is not going to get any better.

Add to this the average male and female now live into their 80s and will receive benefits for 20-25 years and you begin to see the mess the politicians and their co-conspirators have gotten us into.

Now, think about this. There are an estimated 1,000 Trillion dollars in unpaid derivatives contracts out there. The trillions in bail-out money hasn't even scratched the surface. The global economy is only 35 trillion dollars, so that gives you a small taste of the magnitude of the real problem.

This "health reform" law is nothing more than a political distraction, designed to take our focus off of the fact that:

1. The Federal Reserve Banking System has robbed us blind.

2. The national debt, most of which is owed to the Fed for using their worthless paper currency, has robbed us of our future.

3. One thousand trillion dollars in derivatives contracts will lead to a major debt default with hyper-inflation. Our creditors will use this as a pretext for war. Don't believe me? Just ask Argentina what happened when they defaulted on foreign debts. They lost the Faulklands.

4. Illegal immigration, with little enforcement, has made our labor force even less attractive to many employers. We cost money. They cost little.

Dissenters To Be Detained As “Enemy Belligerents”?

This is not a joke and this is very serious. Just read it all and think about what has gone on of late.

Since the establishment media is convinced that tea party members, 9/11 truthers, libertarians, Ron Paul supporters, and basically anyone with a dissenting political opinion is a likely domestic terrorist, they should be celebrating the fact that a new bill would allow the government to detain such people as “enemy belligerents” indefinitely and without trial based on their “suspected activity”.

The “Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010,” introduced by Senators John McCain and Joseph Lieberman on Thursday with little fanfare, “sets out a comprehensive policy for the detention, interrogation and trial of suspected enemy belligerents who are believed to have engaged in hostilities against the United States by requiring these individuals to be held in military custody, interrogated for their intelligence value and not provided with a Miranda warning,” The Atlantic "A Detention Bill You Ought to Read More Carefully"...

The bill does not distinguish between U.S. citizens and non-citizens, and states that “suspected belligerents” who are “considered a “high-value detainee” shall not be provided with a Miranda warning.”

A person is considered a “high value detainee” if they fulfil one of the following criteria.

(1) poses a threat of an attack on civilians or civilian facilities within the U.S. or U.S. facilities abroad; (2) poses a threat to U.S. military personnel or U.S. military facilities; (3) potential intelligence value; (4) is a member of al Qaeda or a terrorist group affiliated with al Qaeda or
(5) such other matters as the President considers appropriate...

Pay specific attention to the powers given to the President in part 5.

I talked and warned about this back last spring when the MIAC report and the Homeland security reports came out. In the reports it describes patriots, gun owners, anti-abortion, Christians, anti-tax, end the Federal Reserve protesters, and Veterans as domestic terrorists. Get ready folks cause Nazi Germany on steroids is coming up on us here in America. I hope not but it doesn't look good.

The miss Labeling of Labels

He takes the different tragedies of late and tries to put these people into the group of right wing extremists. There is only one problem these people have a wide range of views that cross ideological lines. Again the msm tries to divide and conquer us. All of this is to keep us from having a united front.

The shooting contained jarring echoes of other recent attacks, from last month's plane crash at an IRS building in Texas to the shooting last June of a museum guard at the U.S. Holocaust Memorial Museum in the District. Although the circumstances differ greatly, all were acts of rage by men who blamed their personal misfortunes on what they perceived to be sinister forces within the government

All three also appear to have drawn ideological nourishment from the same well: online communities of like-minded people who validate and amplify extreme views. Today, more than in recent years, such communities are tapping into a broad undercurrent of anti-government discontent fueled by economic recession, joblessness and concern over the growing federal deficit, according to experts who have studied the phenomenon

For Bedell and others like him, Washington and its institutions are an irresistible target -- the "ultimate symbol of power for the powerless," said Jerrold Post, a professor of political psychology at George Washington University.

"We've always had individuals who strike out at the giant 'system' when they're feeling a sense of powerlessness and insignificance," said Post, author of "Political Paranoia: The Psychopolitics of Hatred," a book on extremist movements. "Now we see an alarming tendency in which these same individuals can find substantiation online for almost any point of view."...

Get ready for the msm attack machine to go into high gear. They will use every trick in the book to get you to think that the other guy is a radical. This is a sure sign that the establishment is in fear of loosing the power they have had for more than sixty years. Don't underestimate these people, they are ruthless, and will do whatever it takes to maintain their control.

It is Time to Stop Being and Start Being

Calling all Americans. It is time to stop being good Democrats and Republicans and start being good Americans. One asks why and how? I will explain why before I go into how.

For way to long we have been divided in this country. We have been divided between liberal-conservative, left-right, and Democrat-Republican. You see the establishment and the controlled msm keep us in these camps. The left commentators blame everything on the evil right and the right blames everything on the left. This is how they keep us divided. We spend more time fighting with one another and in reality we have more in common than we do not. Jesus said a house divided cannot stand. The old divide and conquer strategy and it is working masterfully. You see if they can keep us fighting over the little things then the elite can get those politicians to pass bills that really matter to them. Granted that their has been some bills defeated but that is cause we have come together and stood as good Americans.

This how we stand together. We look at the issues that really matter and that we agree on. We stick to the Constitution (all parts of it) and demand our elected officials follow it ( cause they take an Oath to the Constitution.) Once the federal government has been rolled back into the boundaries of the Constitution. Then we at the state and local level can have a legitimate debate and action on how we execute the solutions to the differences and problems.

I know that this is contrary to most of our political philosophy. I know that this will take a lot of swallowing of pride. I know that it will be a long hard process and not a overnight solution. But we didn't arrive here in this situation over night. I know we will have to put country first and political parties and personnel agendas last.
